11/29/07 - Translation Needed For This Article About Acosta, Brakewood, Crane, Didden, Lopez, Pilla, Quiroz, And Sorensen

UPDATE:

Has Provided A Translation:

Many have been asking about the English translation to the last post, so nice to see that our blog is getting around...here it is:

When Mayor Dennis Pilla invited Port Chester residents to submit their letters of interests and resumes for village trustee appointments, three Hispanics answered Pilla's call...they were Rev. Ariel Acosta, Blanca Lopez, Director of a not for profit housing program, and Walter Quiroz, a tax accountant.

So what happened?

From the twelve candidates who sought appointments, the Board of Trustees appointed two African American men for the two open seats.

And why wasn't a Hispanic appointed?

It is not that there weren't any Hispanic candidates who were not prepared for this position. It is the opinion of this writer that Ms. Lopez was the best candidate for this position, but the two Republican Trustees, Robert Sorensen and Dominick Cicatelli, and the formerly registered Republican and now Independent Trustee, John Crane decided not to vote for her. Why?...because they felt that Lopez was too involved in politics since she was the Campaingn Chair for Trustee Brakewood and former Trustee Pilla when they ran two years ago, and also Chair for Mayor Pilla, when he ran last year. So, Lopez only received votes from Mayor Pilla and Trustee Brakewood in her quest to becoming appointed.

Wow...never in the history of Port Chester, has a Hispanic woman...an immigrant woman, I should say, like Lopez been involved in promoting change for this community and in such a short time; and that is possibly why, because of her involvement, that is has also created some backlash, because we all know that when an individual or group of people advance in this social system that we live in, there will always be people who will try to stop their progress.

So, lets analyze reasons why these three Hispanic candidates were not appointed....

Early last year, Rev. Acosta ran for Trustee with the Republican team. He ran with Mr. Cicatelli, and Bart Didden, our favorite village racist who was the mastermind behind the so called anonymous flyers where he referred to Lopez as a "wolf dressed in sheep's clothing and that she was "in bed with Pilla." It was discovered that he had assistance from current Trustee John Crane and then Board of Education President Dominick Bencivenga with the planning and editing for this flyer. Everything came out in the open when the Dept. of Justice questioned Didden and he immediately vomited to the feds everything he knew and those involved.

So, it seems that although Rev. Acosta wanted to become involved in this campaign to promote Hispanic participation and most importantly, get the Hispanic vote, the Republicans used him to promote their stance with Hispanics and to show the feds that they had recruited a Hispanic to run with them. Sadly, although Rev. Acosta wanted to be appointed to one of the open trustee spots, nobody voted for him, not even his republican counterparts, Cicatelli or Sorensen. I think that the Republicans used Acosta for their own benefit, and when he needed them they left him out to dry. Poor Reverend, he did not deserve this.

Mr. Quiroz also submitted his resume like a good citizen, but I do not think that he knew much about what this position entailed.

Well, so now lets analyze why

Lopez was not appointed, and this will be easy:

First, there is a rumor in PC that Trustee Sorensen wants to run for mayor in two years, and for trustee this coming March, so now he has to work very hard to please the Republican party and he needs to strenghten his position in it. The problem with Sorensen is that he owes a lot of money to the village because he has not paid his parking tickets. I do not think that PC voters will suppot a candidate who owes money to the village and who has shown to be a bad example for village voters. Maybe Sorensen should give up some or all of the $5k he gets from serving as trustee every year, and maybe that will satisfy his debt.

On the other hand. Mr. Cicatelli just looks lost....he lost the mayoral election, and now he is serving a term that has already expired. It seems that his vote against Lopez, was simply for revenge.... well, that's politics.

So what about Crane....who changed his party affiliation from Republican to Independent a couple of months ago, and who also wanted to be appointed Village justice earlier this year. Unfortunately, Crane, an attorney, represents landlords like Great American, who exploit Hispanics and rent "problematic" apartments and rooms. Seeing how Lopez works in the housing area and knows about housing policies and laws, she may have been seen as a challenge for Crane. Also, it is not surprising that he voted against her since he was involved in the creation of the flyer which was sent to every voter in Port Chester.

There are so many things going on in this little village. It reminds me of a Mexican soap called "Pueblo Chico, Infierno Grande." But, we have to recognize that the appointments made by the trustees was a slap in the face to Hispanics. How is it possible that in a community with a large Hispanic population, there is no Hispanic representative? However, it is also important to understand that if and when a Hispanic candidate runs for office, he or she must be professionally prepared and want what is best for the entire community. But that person must also know about the problems and challenges faced by immigrants as they acculturate into American society.

It is important that we as voters learn and understand each candidate's platforms and the relationship that they will have or have with the Hispanic community, in order to be assured that they will perform a responsible job once in office.

11/03/07 - Lazy Liz Sadler Of The Journal Snooze Gets Up To Speed And Finally Reports On Joe Carvin Accepting Bart "The Bigot" Didden's Donation

Supervisor Wanna Be Joe Carvin and Rye town GOP Chairman Dan "I Would Probably Take Money From David Duke" Paniccia Refuse To Return The Dirty Money They Got From Bar "The Bigot" Didden

HEADLINE:

Do You Want To Get Into Politics But You Have Been Repeatedly Rejected Because You Have Vulgar Beliefs That Involve bigotry, prejudice, violence, oppression, stereotyping or discrimination?

Well Pick Up The Phone And Call (914) 939-7116 And Tell Rye Town GOP Chairman Dan "I Would Probably Take Money From David Duke" Paniccia That You Want To Donate To That Reckless Hedge Fund Guy Joe Carvin Founder Of Altima Partners.

QUOTE:

"I have no problems taking contributions like that." - Rye town GOP Chairman Dan "I Would Probably Take Money From David Duke" Paniccia. Quoted By Lazy Liz Sadler Of The Journal Snooze.

STORY:

Rye Town Supervisor Robert Morabito has stongly criticized the Rye Town Republicans for knowingly accepting a last minute contribution from Bart "The Bigot" Didden, the author of a widely criticized campaign flier that was mailed to 1000 voters before Port Chester's village election in March.

The disgusting flier was a hateful and racist attack on Port Chester Hispanics.

Bart "The Bigot" Didden flier was the first and only Port Chester Campgain piece that contained any racial overtones whatsoever.

However, Rye Town Republican Chairman Dan "I Would Probably Take Money From David Duke" Paniccia has shown everyone just how ignorant he is by saying that the flier had nothing to do with the town election. and that the committee cannot scrutinize every potential donor.

Well I have got a news flash for Rye Town Republican Chairman Dan "I Would Probably Take Money From David Duke" Paniccia the truely decent people of Port Chester and Rye Brook don't want to support any politician that accepts dirty money from Bart "The Bigot" Didden.

At just what point would Rye Town Republican Chairman Dan "I Would Probably Take Money From David Duke" Paniccia start to have a problem with "taking a contribution like that."

  • Would Rye Town Republican Chairman Dan "I Would Probably Take Money From David Duke" Paniccia have a problem taking dirty money from Bart "The Bigot" Didden if he had attacked African Americans instead of Hispanics?

  • Would Rye Town Republican Chairman Dan "I Would Probably Take Money From David Duke" Paniccia have a problem taking dirty money from Bart "The Bigot" Didden if he had attacked Catholics instead of Hispanics?

  • Would Rye Town Republican Chairman Dan "I Would Probably Take Money From David Duke" Paniccia have a problem taking dirty money from Bart "The Bigot" Didden if he had attacked Jews instead of Hispanics?

Supervisor Wanna Be Joe Carvin should imediately return all of the dirty money that Bart "The Bigot" Didden gave to his campaign.

Rye Town Republican Chairman Dan "I Would Probably Take Money From David Duke" Paniccia bogus claim to that the Rye Town Republican Committee cannot scrutinize every potential donor is so bogus.

Rye Town Republican Chairman Dan "I Would Probably Take Money From David Duke" Paniccia really thinks that the voters of Port Chester are Rye Brook are stupid.

First he tells Lazy Liz Sadler that he is too incompetant to scrutinize every potential campgain contribution to Joe Carvin and The Rye Town Republican Committee.

But then Rye Town Republican Chairman Dan "I Would Probably Take Money From David Duke" Paniccia praises his hatefilled buddy by saying, "Bart wants to see some change."

At Least, Port Chester Republican Chairman Billy Villinova and the entire Port Chester Republican Committee has sent a letter to the Westmore News condeming Bart "The Bigot" Didden in the stongest terms. The Port Chester Republican Committee has even demanded that Bart "The Bigot" Didden to appoligize to the people mentioned in his hate filled flier.

Even Bart "The Bigot" Didden's former running mate Port Chester Deputy Mayor Dominick Cicatelli has said that he wanted to send everyone involved with the racist flier to the Port Chester Ethics Board.

Rye Town Republican Chairman Dan "I Would Probably Take Money From David Duke" Paniccia shows everybody how ignorant he is by saying, I have no problems taking contributions like that."

STORY:

Once again Joe "The Harvard Educated Fool" Carvin
has shown his total lack of good judgement.

The last Rye Town Republican Financial Disclosure Report shows that the Carvin Campaign is taking Bart “The Bigot” Didden’s dirty money.

The word around Port Chester is that Bart "The Bigot" Didden has gained unusually free access to the top levels of the Carvin Campaign, due to his close friend ex- Port Chester Republican Chairman Janus "I Love A Racially Charged Campaign" Richards.

Bart "The Bigot" Didden is also gaining access to the Carvin campaign due to the fact that Didden is the Chief Pollster and a part-time columnist to the hopelessly biased rag known as the Westmore News.

Richard Abel, the publisher of the hopelessly biased rag known as the Westmore News has repeatedly defended Bart “The Bigot” Didden by saying, “It’s not against the law to be a bigot.”

Port Mayor Pilla and various Port Chester trustees have been shocked at the Westmore news publisher’s shocking remarks.

When Port Chester Deputy Mayor Dominick Cicatelli and Trustee Dan Brakewood both went on cable TV and called for Bart “The Bigot” Diiden’s resignation from the Port Chester Planning Board Guess What Happened?

Westmore News Publisher Richard Abel made it clear that his newspaper would not look favorably on having it’s chief pollster and part-time columnist sent to the Port Chester Ethic’s Board for his two page racist flier.

As of October 29th, neither the Westmore News founder, publisher or editor has condemned their part-time columnist’s racist flier that attacked Port Chester Hispanics in general and Port Chester Hispanic Activist Blanca Lopez specifically.

THE RYE BROOK HEDGE FUND MILLIONAIRE JOE “THE HARVARD EDUCATED FOOL” CARVIN IS SO GREEDY HE TAKES DIRTY MONEY FROM
BART “THE BIGOT” DIDDEN.

Instead Of Taking Bart “The Bigot” Didden’s Dirty Money Joe Carvin should be demanding that Didden apologize to all of the Hispanics of Port Chester and to Blanca Lopez in general for the racist two page flier.

Port Chester Republican Chairman Billy Vilanova publicly called for Bart “The Bigot” Didden to apologize for the racist flyer after ex-Port Chester Chairman Janus “I Love A Racially Charged Campaign” Richards stepped down to be a Carvin confidant and advisor.

JOE CARVIN SHOULD RETURN BART “THE BIGOT” DIDDEN”S MONEY AND DEMAND THAT HE APOLOGIZE FOR THE TWO PAGE RACIST FLIER THAT ATTACKED THE HISPANICS OF PORT CHESTER AND VICIOUSLY SINGLED OUT BLANCA LOPEZ.

10/26/07 - BB914914@aol.com Sent Port Chester Roundup An Email About The AM Report And The We$tmore $nooze

Port Chester Round up Answers An Email

HEADLINE:

Is Bart "The Bigot" Didden The Chief Pollster And Part - Time Columnist For The Hopelessly Biased We$tmore $nooze And Other Lowlife Republican Operatives Hiding Behind Fake Email Accounts Again ?

STORY:

I got an email from BB914914@aol.com .
When We$tmore $nooze Chief Pollster And Part - Time Columnist Bart "The Bigot" Didden had his butt dragged before a Federal Judge, he admitted under oath that he often created bogus email accounts to use on blogs.

Moreover, I know for a fact that Bart "The Bigot" Didden, who was the author and distribute of the disgusting two page flier use AOL at home, because he on of Port Chester Roundup's most frequent visitors.
However, I am going to assume that "BB914914" is a legitimate email account and not some weakling Republican operative trying to help out the hopelessly biased rag known as the We$tmore $nooze.
Anyway, BB914914@aol.com sent the following email to Port Chester Roundup.....

"There is some news that you miss like some stuff that is in the AM report on the journal news there is also some good stories that the westmore has that you never get."

Port Chester Roundup Responds To BB914914

I have tried to find Internet links to the Journal News AM Report, but it appears that the AM Report online.
I think the AM report is kind of like an area police blotter that usually mentions things like so and so got caught stealing a candy bar at Pathmark.
I think it's boring to report on petty criminals.
Personally, I like reporting on guys like Port Chester Development Consultant Gary Gianfrancesco who got Over 1 Million Dollars for Horton School.
I also like reporting on how Rye City Republican Chairman Anthony Pisconere and Aldo "The Patronage Boy" Vitagliano got $750,000 for losing a one week trial.
I also like reporting on how a low-balled BMW Building Permit cheated the single family homeowners out of $100,000 Dollars.
However, if you can find a link to this AM Report, I will gladly put up the link.
Now BB914914, I have put many links up to the hopelessly biased rag know as the We$tmore $nooze, but many persons have came up to me and complained about the links.

The Problem is that We$tmore $nooze Publisher Richard "The Rye Town Drama Queen"Abel is very very greedy.
When you click on a We$tmore $nooze link you get spammed by the newspaper that was founded by Bernie "I Forgot To Pay Over 100 Property Tax Bills" Abel.
If you click on all the We$tmore $nooze links below you will not get one news story. You will only get the greedy abels begging for 30 bucks.
Go ahead BB914914 click on the links and get spammed the greedy Abels.

10/10/07 - Why Wasn't Bob Sorensen Informed About Bruno Gioffre Bringing Another Bad Condo Project To The United Hospital Site In Port Chester

HEADLINE:

Would Someone Please Explain To Trustee Bob Sorensen That His So-Called Republican Buddies Aldo "The Patronage Boy" Vitaliano And Bruno "Spot Zone" Gioffre Want To Bring Another Massive Multi - Family Apartment Building To Port Chester

QUOTE OF THE DAY:

"It was a surprise to me" - Trustee Bob Sorensen

STORY:

Even though Mayor Dennis Pilla said that there would be no public or trustee comments at the October 9th Work session, he went ahead and let the trustees make comments at the meeting.

Trustee Robert Sorensen said that he was upset that he read about the United Hospital project yesterday morning and that he already had two calls before he got to his newspaper sales job in Stamford.

Trustee Sorensen was very upset that the press had been briefed about the project before he was.

Mayor Pilla said that there had been a great deal of talk in the community about the Massive Multi - Family Condo project and that Trustee Sorensen was present during board comments about this project that will increase school taxes a few weeks ago.

Plus Mayor Pilla said that there had been a previous story in the Westmore Snooze.

COMMENT:

Doesn't Mayor Pilla realize that Trustee Bob Sorensen probably never reads the hopelessly biased We$tmore $nooze, since Richard "The Rye Town Drama Queen" Abel encouraged ex-We$tmore $nooze columnist and chief pollster Bart "The Bigot" Didden to go after his family for all those parking tickets.

Richard "The Rye Town Drama Queen" Abel sure did use a lot of space in the We$tmore $nooze to attack Trustee Sorensen and his family, because they paid a lot of money to the Village Of Port Chester for parking tickets.

Trustee Sorensen has probably heard how Richard "The Rye Town Drama Queen" Abel has bragged to scores of people about how he will never be re-elected because of all the biased stories and letters that appeared in the We$tmore $nooze.

I bet Bob Sorensen dose not read the Westmore Snooze, because they allowed Bart “The Bigot” Didden to unfairly attack his family over parking tickets in the Hopelessly Biased We$tmore $nooze.

08/10/07 - Let's Really Get Serious About Fines. We Should Start Giving Huge Tickets To Cusamano, Didden and Gianfrancesco.

THE TRUE BLUE

CONSERVATIVE REVIEW

HEADLINE:

TELL MAYOR THAT IT IS TIME TO START USING FINES TO COVER THE COSTS OF HAVING CUSAMANO, DIDDEN AND GIANFRANCESCO INVOLVED IN PORT CHESTER GOVERNMENT.

STORY:

Soon the residents of Port Chester will hopefully get the oportunity to speak at a public hearing about increasing and adding new fines in the village of Port Chester.

The village staff and the Mayor are correct when they say parking fines have not been updated often enough. It is an excelent idea to try and have the fines at least cover the cost of enforcement.

Most of the fines will go up about $5.00 a ticket.

There is also talk of a much more increasing downtown parking meters by 25 cents. This is a 50% increase over the current 50 price.

These minor changes are fiscally responsible and should help the village balance its budget.

But why should the Village stop at Parking meters.

Let's recoup all of our lost costs.

Maybe we could fine Port Chester Building Inspector Lenny Cusamano $250 for each week that he fails to shut down an illegal apartment in Port Chester.

Or, maybe we could fine Port Chester Planning Board Member Bart Didden $500 a day for everyday he occupies his Main Street offices without a certificate of occupancy.

Or better yet, maybe we could fine Port Chester Developement Consultant Gary Gianfranseco $5,000 everytime he files a change order on that bottemless money pit known as Horton School.

God Knows, Gary can easily afford it, because he has already stuffed over a million of your tax dollars in his pockets while being involved on this project.

Archive 2007 January 31 Port Chester News Wire

Charged with manslaughter in the second degree
(WABC, January 29, 2007) - A 60-year-old woman is charged with using her car as a weapon to kill her ex-boyfriend.

It happened near the victim's home on Exchange Place in Port Chester.

Eyewitness News reporter Marcus Solis is there with the story.

Police say that after the suspect hit her ex-boyfriend, driving 20 miles north to her town of Mount Kisco and went to police there, and that's where she was promptly arrested.

Maureen Jackson headed to court today to face manslaughter charges. Police say last night the 60-year-old ran over and killed her ex-boyfriend in a fit of rage.
Around 9:30, officers found Jeffrey Scribman on the ground. He would die a short time later. According to police, Scribman was trying to stop Jackson from driving away from his apartment.

The libertarian economics professor opines: "Can the government force one to sell his property? James Madison said yes, so long as it was for a public use and the owner was paid a fair market value. Thomas Jefferson was opposed to a person being forced to sell his property for a public use, arguing that the essence of private property is the right to exclude anyone, including government, from the property. But Madison's view prevailed, hence the Fifth Amendment provision. In recent years, state and local governments have been running roughshod over private property rights in ways that would have horrified our founders. In the 1959 Courtesy Sandwich Shop case, a New York court held that if the tax collector collects more taxes by taking the private property of one party and transferring it to another, that's a public use permitted by the Constitution. Recently, the city of Port Chester, N.Y., gave a private developer virtual power to condemn property within its designated redevelopment area. Bart Didden and Dominick Bologna, owners of property within the redevelopment area, approached the private developer for a permit to build a CVS pharmacy on their land. The developer told them to pay him $800,000 or give him a 50 percent interest in the CVS pharmacy or he'd have the local government condemn the land. Didden and Bologna refused, and the next day their land was condemned. The 2nd U.S. Circuit Court of Appeals upheld the local government's decision, which is nothing less than sanctioning extortion. Napolitano concluded his speech pointing out something that few Americans appreciate. Natural rights do not come from government; they spring from our humanity."

The Canceled Library Meeting Will Now Be Held On January 23rd.

The Port Chester And Rye Book Board Of Trustees will sit down with the Port Chester Public Library Board headed by Kathleen Giofree.

Hopefully, NYU Professor Allen Zerkin will still moderate the meeting.

Supposedly, Professor Zerkin is an expert at governmental conflict resolution.
The last meeting was cancelled, because Mayor Logan ssays he forgot to look at his calendar, and he latter discovered he had some kind of conflict.
Many residents want to know what was more important than our library.

Sorry Bart, But The Supreme .....

Court Won't Hear Eminent Domain Case

The Supreme Court on Tuesday refused to consider a property rights case involving a redevelopment project in New York state where businessmen are fighting local government efforts to take their land.

The businessmen say the village of Port Chester, N.Y., filed a condemnation petition to acquire their property the day after the businessmen rejected what they said was a demand by the project developer for $800,000.

The developer allegedly was demanding the money or a 50 percent interest in the businessmen's own project to put a CVS Pharmacy on the site.

Abel's Fables

UNFAIR AND UNBALANCED

Part-time Westmore Snooze Columnist and Chief Pollster Bart Didden has once again proven that he is not only a Republican Candidate for Trustee. He is also Port Chester's very own village idiot.

Bart Didden recently was highly critical of Mayoral Candidate Deennis Pila for being absent from a recent board of trustees meeting. You would think that the fact checkers at the Westmore Snooze would inform Bart "The Village Idiot" Didden that Trustee Pilla has the best attendance record of anyone else on the Port Chester Board Of Trustees.

Worse yet, Bart "The Village Idiot" Didden failed to notice that two other Republican Trustees were missing from the very same meeting.

It is a shame that Richard "The Republican Spin Meister" Abel could take a moment to inform his part-time columnist and Chief Pollster of the facts concerning the pitiful attendence records of some of the Republican Board of Trustee Members.

I guess Mr. Abel was too busy having one of his almost daily meetings with Port Chester Republican Chairman Januez Richards.

Richard "The Republican Spin Meister" Abel always claims that the Westmore Snooze is beholden to no political party.

Why then did he allow his part-time columnist and Chief Pollster to falsely attack the Democratic Mayoral candidate that has only missed one meeting out of the last forty three meetings.

Maybe Richard "The Republican Spin Meister" Abel should post the attendance records of all of the current Port Chester Board of Trustee members.

Trustee Dennis Pilla and Trustee Dan Brakewood both have near perfect attendance, while the republican members of the Port Chester Board of Trustees have much lower attendance percentages.

Maybe Richard "The Republican Spin Meister" Abel, Januez Richards and the Village Idiot should go look at the Public Attendance Records before attacking Democratic Mayoral Candidate Dennis Pilla.

I am sure that Richard "The Republican Spin Meister" Abel will have his Part-Time Columnist and Chief Pollster report on the attendance record of Republican Mayoral Candidate Dominick Cicatelli in next weeks edition of the Westmore Snooze.

Don't hold your breath waiting.

The Republican Board Of Trustee Members should take there responsibilities as seriously as Trustee Dennis Pilla and Dan Brakewood do.

When is the Westmore Snooze going to stop being UNFAIR AND UNBALANCED.

Let's solve the year old Port Chester Library Funding Problem once and for all.

Let's hope that Mayor Gerald Logan and the entire Port Chester Board Of Trustees are in attendance for the Library Meeting on January 17th. Port Chester Board attendance has been disgraceful lately.

Port Chester will need a full board there in order to solve the library funding problem.

Port Chester and Rye Book both have to decide what they are going to do.

Rye Brook has a very, very good deal. If the want to walk away and spend more money then let them waste their citizen's tax dollars.

Either we’re going to have a library with Rye Brook or we’re not.

If not, then we have to roll up our sleaves and fix the Port Chester Library.

First lets get rid of Bruno and Kathleen Giofree and then lets start spending the 3 million dollars the library has to start fixing up the place.

No one in Port Chester can truely say that they think that Mayor Gerald Logan will go against his realitives the Giofrees.

Rye Brook has insisted that part of the negotiation was the library name change.

As part of any funding agreement, Rye Brook had asked that the name of the library be changed to the Port Chester-Rye Brook Public Library, which is major problem with many long time library patrons.

Many is Port Chester feel that a name change shouldn’t be part of these negotiations.

However, these people need to undderstand that the library has repeatedly changed its name over the years.

Ask Goldie Soloman about the Peck Library.

Rye Brook says that it is willing to increase its percentage of funding from the 30% to 35 % it currently gives in exchangge for the name change.

This is not enough

If Rye Brook wants 50% of the name, then they need to pay 50% of the bill..

Port Chester Trustee Robert Sorensen has worked very hard on the library funding and name change issues.

Port Chester Trustee Dan Brakewood has had innovative ideas about the possibility of a library district.

Maybe Mayor Gerald Logan and his Giofree relations should step a side and let Soreensen and Brakewood hammer out a deal with Rye Brook.

The meeting on January 17th will be moderated By NYU Professor Allen Zerkin. Lets hope Professor Zerkin knows the issues and can get this year old library funding problem solved.

This is starting to get boring.

Kelo-Property Rights Update: An Awful Case May Get Heard by the Supremes

Filed under: Economy, Taxes & Government — TBlumer @ 7:39 am

This second item (HT Russell’s Rhetoric) is difficult for me to present without violating the site’s PG-13 standard, but here it is:

Bart Didden wanted to put a CVS pharmacy on his property in Port Chester, N.Y. He even obtained approvals from the local planning board.

But because a portion of the CVS site was in a blighted redevelopment zone, Mr. Didden was told that planning board approval wasn’t enough. He’d have to reach an understanding with a private company that had been selected by Port Chester officials to control all construction inside the renewal zone.

The developer, Gregg Wasser of G&S Port Chester, told Didden he’d have to pay $800,000 or give G&S a 50 percent stake in the CVS business. If Didden refused, Mr. Wasser said, he would have Port Chester condemn and seize his property and instead of a CVS he’d put a Walgreens drugstore on the site.

Didden refused. The next day, the Village of Port Chester began legal proceedings to seize Didden’s land by eminent domain.

Lawyers for Didden took the matter to federal court. They even went to the FBI - all to no avail. Now they are asking the US Supreme Court to examine whether a private company can demand payment in exchange for refraining to seize private property in an urban renewal zone.

Property rights activists are hoping that a majority of the justices view Didden’s case as an opportunity to clarify a portion of the high court’s controversial decision in its last big eminent domain case, Kelo v. New London. In that June 2005 opinion, the court ruled 5-to-4 that local governments could seize private property and turn it over to a private developer when the action was part of an economic development project of benefit to the public.

So the bad news is that this is the kind of overarching tyranny those who opposed the Kelo ruling feared. The good news is that it could be reviewed by the Supreme Court, which, with the arrival of two new justices since the infamous June 2005 ruling, might decide to rule in a sweeping fashion, perhaps overturning Kelo. Another piece of good news is that the Institute for Justice is involved
