Port Chester can't appeal the consent decree that brought cumulative voting to the village, a federal judge wrote Friday.

By Nik Bonopartis

Can Port Chester appeal the consent decree that brought cumulative voting to the village?
According to a federal judge, probably not.
Judge Paul Gardephe likened the consent decree to a contract: the written terms of the contract are what matter, Gardephe wrote, and the contract doesn't make allowances for Port Chester's lawyers to return and finesse the finer points of the agreement.
The village's attorneys disagree and say they're undaunted by the opinion, which was released Friday. The next step? Lawyers for Port Chester will prepare arguments for circuit court, where a panel will decide whether the appeal can move forward.
Anthony Piscionere, an attorney on retainer by the village for the voting rights case, said it would likely take several months for arguments and a decision by the circuit court panel.
In the meantime, Mayor Dennis Pilla said he plans to revive an earlier resolution to contract another legal expert for a second opinion on Port Chester's chances in this latest legal battle....

03/07/11 Port Chester Lost The Voting Right Case, Because Of The Reckless Actions Of Bart Didden

Port Chester voters will go to the polls March 15 to fill the mayoral position.

Port Chester Mayor Dennis Pilla, is running for a third two-year term against challenger Extreamist TEA Party Lunatic Bart "The Bigot" Didden,

Didden joined the village board in June in the landmark election for all six Port Chester trustee seats.

This was the first election held under the cumulative voting voting system that Bart "The Bigot" Didden's racist flier created.

The Department of Justice had to prove THREE POINTS points to win the voting rights case in Port Chester.

The United States Department Of Justice argued that Port Chester's existing at-large system violated the Voting Rights Act, which protects minorities' constitutional right to equal protection under the law.
  • DOJ Lawyers found that the population of 28,000 was about half Hispanic, they argued that the system prevented Hispanics from getting a representative on the six-trustee board. This proved the FIRST POINT that the DOJ needed to win the voting rights case against Port Chester.
  • The Justice Department also found that no Hispanic had ever been elected trustee or mayor in the village. This proved the SECOND POINT that the DOJ needed to win the voting rights case against Port Chester.
  • But the DOJ lawyers had a problem. They still had to find that there had been a racial appeal in a Port Chester election in order to make the third point that they needed to win the voting rights case. The DOJ just could not find any evidence a racial appeal was ever made in a Port Chester election. Despite at looking at over a decade of campaign literature the DOJ just could not find ONE piece of paper that ever showed that there had been a racial appeal in an election in Port Chester.
  • Then Bart "The Bigot" Didden made that TWO page racist flier that attacking Blanca Lopez and Port Chester's Hispanics. This proved the THIRD POINT that the DOJ needed to win the voting rights case against Port Chester.
Bart Didden's racist flyer was followed by a trial in which U.S. District Judge Stephen C. Robinson, after hearing evidence of a litany of wrongful conduct, found the village unlawfully disenfranchised Hispanic residents. At the time the suit was filed, the village had never elected a Hispanic candidate to anything — neither to the village board nor school board — despite Hispanics making up about half the population.

Judge Robinson's also found that during the 2007 mayoral election, a blatant racial appeal was made to voters — in the form of an anonymous flier distributed to 1,000 homes — disparaging of Hispanics and crudely complaining of their influence. The one factor that had to be considered in voting rights cases.

The DOJ had to show that a Port Chester political campaign included overt or subtle racial appeals and Bart "The Bigot" Didden delivered them a two page racist flier.

Soon it was subsequently learned that the two page flier was written by Bart Didden, who is now a candidate for mayor.

Yes it is true, Bart "The Bigot" Didden's racist two page flyer gave the Department of Justice the missing piece of the voting rights case puzzle.

Now Bart "The Bigot" Didden wants to spend another $225,000 in taxpayer money — on top of the $1.2 million spent so far — to continue a community-dividing legal fight he helped create with his racist flyer.

03/03/11 A Recap Of Last Nights Port Chester Mayoral Forum Hosted By The League Of Women Voters

League Of Women Voters Forum Was Ba Ba Ba Ba Booooooring ........

Port Chester Residents Looking For Fireworks Were Disappointed Last Night

Last Nights’s public forum for the Port Chester mayoral candidates brought a few differences between Bart "The Bigot" Didden and Port Chester Mayor Dennis Pilla.

The decision on whether to spend another million dollars to appeal the voting rights decision,

Bart's perception of the village finances

Overall, incumbent Mayor Dennis Pilla clearly demonstrated progress on everything from code enforcement to corruption-fighting within the ranks, while Republican nominee and Trustee Bart Didden repeatedly tried in vain to put together an argument of “mismanagement.”

Mayor Dennis Pilla noted the recent upgrade of Port Chester’s bond rating to its highest ever, coming despite declining sales and mortgage taxes.

A couple times, the candidates were asked what they would do to foster more unity and tolerance among village residents.

Extremist TEA Party Lunatic Bart "The Bigot" Didden avoided the question by saying, “The divide is between government and the people.”

Mayor Dennis Pilla said the community is mainly tolerant but that the board itself had to set a more civil tone, rather than fan the flames.

“If you watch the meetings on TV, and I don’t mean to disparage, but it’s as though they’re throwing lighter fluid on a fire that’s already partially lit,” the Mayor Pilla said.

One specific policy difference that I hadn’t heard before was on the potential for sharing services with Rye and Rye Brook.

Mayor Dennis Pilla said he and the village manager met recently with Rye about sharing code-enforcement functions and fire services. He noted that Rye Brook already pays a fee in return for service from volunteer firefighters.

Bart "The Bigot" Didden dismissed the notion that the wealthy, less-racially-diverse neighboring communities wanted any deals with Port Chester.

“You think Rye Brook wants a lot to do with Port Chester? Asked Extremist TEA Party Lunatic Bart "The Bigot" Didden.

The City of Rye, they don’t want us over there. They don’t want us in their park, they don’t want us on their beach, and we have to maintain our rights and our ability.”, Extremist TEA Party Lunatic Bart "The Bigot Didden Continued.

It looks like Extremist TEA Party Lunatic Bart "The Bigot" Didden is arguing that those Rich WASPs in Rye And those Rich Jews in Rye Brook want nothing to do with those down and out Guidos and Wet Backs in Port Chester.

It sort of reminds one of when Bart "The Bigot" Didden's racist political flier said,"The Hispanics Are Running The Show In Port Chester." and when when Bart "The Bigot" Didden's racist political flier continued with,"Don't elect carpet baggers [ie. Hispanics], elect people who care about our history, heritage and what our kids will be told about us in the future. Are we to be known as racists or law abiding free Americans?"

There was no discussion of Extremist TEA Party Lunatic Bart "The Bigot Didden's racist political flier 0r the fact that Bart's Downtown Office Had No Certificate Of Occupancy at the League Of Women Voters event last night.

02/28/11 Port Chester School District Prepares For Layoffs As Village Gives The Rye Town Supervisor's Brother A $750 / Hour Job

The Port Chester School District is bracing for some tough choices as taxpayers are told that long time Republican Michael Carvin will get a $200,000 patronage job from the village.

Board of Education meeting, parents, teachers and board members listened as Maura McAward, assistant superintendent, warned of drastic personnel cuts. The district has already shaved costs by limiting hall monitors and computer aids.

Port Chester parents won't have to wait long for the details. They'll get their first look at the board's proposed budget on March 10; after public input, the board will present a revised budget on March 30. On May 17, voters will head to the polls to approve or deny the budget.

However, Port Chester parents need to understand that taxpayers can't afford Bart Didden and Sam Terenz's desire to fight another futile battle with the United States Justice Department and teachers.

The $200,000 that Didden and Terenzi voted to give the Rye Town Supervisor's brother is just a down payment on another million dollar plus failed lawsuit.

This senseless lawsuit is easily going to eventually raise Port Chester Village taxes by 5%.

Maybe after Bart Didden, Sam Terenzi and Michael Carvin lose in Federal Court the taxpayers might be able to afford some money for school teachers.

Parents We Are So Sorry , But ....

Right Now Port Chester Taxpayers Must Suffer The Consquences Of Bart "The Bigot" Diddens Vote To Give The Rye Town Supervisors Brother A $750 / Hour Patronage Job.

Port Chester Mayor Dennis Pilla Is Still Trying to Stop Sam Terenzi And Bart Didden From Giving Micheal Carvin That $750 / Hour Republican Patronage Job, But He Needs The Help Of The Many Concerned Port Chester Parents.

It's Time For These Port Chester Parents To Protect Their Children's Futures And Stand Up To Extremist TEA Party Lunatic Bart "The Bigot" Didden

Port Chester's Children Should Not Have To Suffer, Because Of Bart "The Bigot" Didden
