New Law Affecting Port Chester
ASSEMBLY BILL #A10239 SAME AS SENATE BILL #S7186 LAWS OF NEW YORK, 2006 CHAPTER 226 (See FISCAL NOTE at end of Chapter.)    
AN  ACT  authorizing  firefighter  John  M.  Suppa,  Jr. to apply for an optional twenty year retirement plan provided for in section 384-d  of the  retirement and social security law and authorizing the village of Port Chester to reopen such optional twenty year retirement  plan  for firefighter John M. Suppa, Jr.    
Became a law July 26, 2006, with the approval of the Governor. Passed on     Home  Rule  request  pursuant  to  Article IX, section 2(b) (2) of the Constitution by a majority vote, three-fifths being present.      
The People of the State of New York, represented in Senate and  Assembly, do enact as follows:      Section 1. Notwithstanding any other provision of law to the contrary, the village of Port Chester, in the county of Westchester, a participating  employer in the New York state and local police and fire retirement system, which previously elected  to  offer  the  optional  twenty  year retirement plan, established pursuant to section 384-d of the retirement and  social  security  law, to firefighters employed by such village, is hereby authorized to make participation in such plan available  to  John M.  Suppa,  Jr.,  a firefighter employed by the village of Port Chester, who, for reasons not ascribable to his own negligence failed to  make  a   timely  application  to participate in such optional twenty year retirement plan.    
 Thereafter, John M. Suppa,  Jr., may  elect  to  be  covered  by  the provisions  of  section 384-d of the retirement and social security law, and shall be entitled to the full rights and  benefits  associated  with coverage under such section, by filing a request to that effect with the state comptroller on or before December 31, 2006.     
§  2.  All  costs  associated with implementing the provisions of this act, including past service costs and  annual  contributions,  shall  be borne by the village of Port Chester and may be paid in ten equal annual installments.     
§ 3. This act shall take effect immediately.

FISCAL NOTE.--Pursuant to Legislative Law, Section 50:     
This  bill will allow firefighter John M. Suppa, Jr. of the Village of  Port Chester to become covered by the provisions of Section 384-d of the Retirement and Social Security Law.   If this bill were  enacted,  we  anticipate  that  there  will  be  an  increase  of approximately $3,400 in annual contributions of the Village  of Port Chester. 
In addition to the annual contributions discussed above, there will be  an immediate past service cost of approximately $81,700 which  would  be borne  by  the Village of Port Chester. If this cost is amortized over a period of 10 years, the cost for the  first  year,  including  interest,    
EXPLANATION--Matter in italics is new; matter in brackets [ ] is old law                                to be omitted.   CHAP. 226                          2 would be approximately $11,300. This estimate is based on the assumption  that payment will be made on February 1, 2007.      
This  estimate,  dated  February  15,  2006  and intended for use only during the 2006  Legislative  Session,  is  Fiscal  Note  No.  2006-166, prepared by the Actuary for the New York State and Local Police and Fire Retirement System.
