Police Shutter Building Department Again; Employees Sent Home
Ten months after launching an investigation into corruption at Port Chester's building department, police have shut the office down again.

In a sign that a 10-month corruption investigation may be coming to a close, Port Chester police shuttered the building department at village hall on Friday, freezing operations and sending employees home.
Details remain few. Port Chester police Lt. James Ladeairous confirmed detectives closed the office on Friday, saying the office is physically off-limits pending action by the police and village government.
Mayor Dennis Pilla also confirmed the lock-down.
"This is yet another step in the journey of rooting out corruption in Port Chester," he wrote in reply to a query from Patch.
The investigation was revealed publicly for the first time last year, when police first shut down the department and hauled away boxes of records on April 29.
Frank Ruccolo, the department's building inspector, was suspended without pay in the resulting investigation, and soon after submitted retirement papers. Although the village drafted administrative charges against Ruccolo, the disgraced former building inspector used the protection of state personnel law to bury the charges when he retired.
As a result, the details of those charges never became public, and village residents have become increasingly frustrated as other suspended former employees used the same legal strategy.
State law says the personnel files of public employees are protected, unless details in those files point to dereliction of duty or other allegations of misbehavior. Two employees have been suspended in an investigation into money stolen from Port Chester's parking meters. Estimates suggest the thefts totaled about $150,000 per year.
On Sept. 22 of last year, former DPW General Foreman Gary Racaniello buried 36 pending administrative charges by resigning.
In a letter, Racaniello told Russo his resignation was "conditioned on" two things: "that all disciplinary charges...are hereby withdrawn" and "that all copies of disciplinary charges (pending or to be lodged), as well as other paperwork related to any other disciplinary charges will not be filed."
In January, village hall brought disciplinary charges against William Oxer, a DPW employee and former chief of the Port Chester Fire Department. Those charges have not been publicly revealed, and Oxer declined to comment when reached by phone.
Oxer's name came up in the parking meter probe as early as November, but his legal troubles were not limited to the meter investigation and hint at the alleged wide-scale corruption involving building department operations–after a home he co-owned caught fire in September, Oxer and co-owner Charles Horton were cited for allowing illegal occupancy, conducting work on the home without permits, and renting the home without installing smoke or carbon-monoxide detectors.
In December, police served the DPW and finance department with a subpoena, marking the third time in one year that criminal authorities took records from village hall departments during corruption investigations.
The investigations and suspensions have fueled political disagreements within Port Chester, sparking heated exchanges and drawing the attention of the district attorney's Public Integrity Bureau.
Mayoral challenger Bart Didden has said the investigations signal a lack of oversight, while imcumbent Mayor Dennis Pilla says it's the staff he's hired and supervised – including Village Manager Christopher Russo and Code Enforcement Director Christopher Steers – have been the driving force behind finding and exposing corruption in the village.
In October, Trustee Sam Terenzi was called in to speak to investigators at the Public Integrity Bureau after an outburst during a public meeting in which he referred to a tipster in the parking meter probe as "a rat." Terenzi and the board's Republicans were accused of trying to fire Robert Lombardi, the assistant village manager who headed the administrative investigations in the parking meter probe.
Republican trustees, including Terenzi, Didden and Kenner, argued that eliminating Lombardi's $79,000-a-year position was a cost-cutting measure, but raised eyebrows among the public for the timing of that effort, days after Lombardi revealed charges in the meter investigation.
After months of praising Code Enforcement Director Christopher Steers for combating corruption and systemically inspecting thousands of homes in Port Chester since taking over enforcement duties from the building department, mayoral candidate Bart Didden issued a campaign press release earlier this month saying those efforts were not enough.
Downtown "is an embarrassment to our residents," Didden said, while criticizing the pace of code enforcement efforts ahead of Tuesday's mayoral vote.

Rye Town Supervisor Joseph Carvin and Port Chester Trustee Joseph Kenner have both endorsed Republican candidate Bart Didden for mayor of Port Chester. 


Carvin, who often speaks about everyone getting along in our community and is a member of the group Building Community Bridges, has stated Didden's (past) racist flyer regarding Hispanics was not racist — it was "race-baiting." Oh, I now see the light. In Carvin's world, it's OK to endorse a race-baiter. 


As for Kenner, he has been advocating that Port Chester appeal the voting rights case ruling because, "We can remove the shameful and unwarranted stigma of the judge's ruling, which affects how others view us." 


Kenner does not seem to worry how other communities outside of Port Chester will view us if we elect a mayor who authored a racist flyer. 


A racist flyer Didden sent out anonymously, told the media he knew nothing about, and then finally told the truth only when under oath during the voting rights trial......

Port Chester refuses to heal

It is disappointing but not surprising that the conservative-minded majority that controls the Port Chester government would vote to reopen an old and costly wound: the 4-year-old legal battle with the U.S. Justice Department over the village's system for electing trustees. Fighting ideological demons and good sense, several trustees over many months had made plain their aim to reopen the case, notwithstanding the uncertainty inherent in any appeal and the dim chances for improving either local governance or civility.


What is surprising is that the trustees driving this community-splitting train — Republican Joseph Kenner and Conservatives Bart Didden, Sam Terenzi and John Branca — so glibly sent the village on this course, which could cost Port Chester more than just dollars and cents.
The four trustees on Tuesday ignored sound advice from a host of taxpayers and village leaders who implored them (1) not to waste their money and (2) to move on. "I wouldn't vote for 10 more cents" to be spent on the case, former Republican Trustee Domenick Cicatelli told the board Tuesday.
"This is a black eye on Port Chester," resident Gary Sullivan said of the Justice Department's successful challenge, under the Voting Rights Act, to the village's system for electing trustees. "It is healed. So now you're going to pay to walk into another punch in the eye?"
Apparently so. By a 4-2 vote, the board agreed to pay a Washington, D.C., law firm as much as $775 an hour, up to $225,000, to appeal a U.S. District Court ruling that forced the village to change its system for electing trustees. This followed a trial in which U.S. District Judge Stephen C. Robinson, after hearing evidence of a litany of wrongful conduct, found the village unlawfully disenfranchised Hispanic residents. At the time the suit was filed, the village had never elected a Hispanic candidate to anything — neither to the village board nor school board — despite Hispanics making up about half the population.
Among Robinson's findings was that during the 2007 mayoral election, a blatant racial appeal was made to voters — in the form of an anonymous flier distributed to 1,000 homes — disparaging of Hispanics and crudely complaining of their influence. One factor routinely considered in voting rights cases is whether past political campaigns have included overt or subtle racial appeals.
It was subsequently learned that the flier was written by Didden, who was elected to the board last year and now is the GOP candidate for mayor. He now wants to spend another $225,000 in taxpayer money — on top of the $1.2 million spent so far — to continue a community-dividing legal fight he helped create.
Although speaker after speaker spoke out against the appeal, Trustee Didden insisted that there was significant public support to reopen the case, albeit not all of it in Port Chester. "Not only here in Port Chester, but at the state level, at Washington, if you don't agree with the progressive left, you get labeled," Didden said. "And I think there's a faction of people out there that are scared to come out." Terenzi accused taxpayers who spoke against the appeal of being supporters of Mayor Dennis Pilla, who is seeking re-election. Pilla, along with fellow Democrat Luis Marino, opposed the appeal.
Ironically, the revised election system suggested by Port Chester and OK'd by the court ended up producing the most diverse village board ever elected in Port Chester, including Marino, the board's first Hispanic, and Kenner, the first elected black. The spirited campaign featured an unprecedented amount of involvement and participation by village residents who often exist on the fringes of civic life. While the overall result left much to be desired — as the decision to appeal might suggest — it was something to build upon.
Tuesday's vote marked a sharp turn right, then backward and into the dark.

The Port Chester Board of Trustees agenda for Monday contains a resolution to authorize the hiring of counsel to appeal the voting rights case. Judge Stephen Robinson found that our historical system to elect trustees violated Section 2 of the Voting Rights Act. The public will have an opportunity to be heard. I wanted to provide the facts that lead to my decision to support what two experienced voting rights lawyers have characterized as a powerful appeal with a substantial likelihood of success.

Prior to being appointed to the board in 2007, I believed that the establishment of voting districts — the typical remedy in Voting Rights cases — would not work. To divide a small village like Port Chester into districts is wrong. The only district the federal government could create with a majority of Hispanic citizen voting-age persons,..... Blah .... An Out pouring of Port Chester residents who heard about Joseph "Uncle Tom" Kenner's
idiotic proposal came to Monday's meeting, despite the lack of official notice that the item was on the agenda.

Almost universally, the taxpayers slammed Joseph "Uncle Tom" Kenner and Michael "My Familiy Is Cashing In" Carvin $750 / hour payout, as they repeatedly said fighting the DoJ would be costly with little chance of success.

Mayor Pilla and Trustee Dan Brakewood pointed out that legal experts said the original fight would cost only $250,000, and "they were off my $1 million," Pilla said, referencing the $1.2 million in legal fees the village has already paid to fight the DoJ.

Still others said it was a retroactive attempt to claim unity and draw attention away from extremist TEA Party lunatic Bart "The Bigot" Didden's track record.

Extremist TEA Party lunatic Bart "The Bigot" Didden, who is running for mayor, inadvertently helped the DoJ make its case when he distributed fliers during the 2007 mayoral election that warned, "the Hispanics are running the show already"

The federal judge cited Extremist TEA Party lunatic Bart "The Bigot Didden's flier as one piece of evidence showing bias against Hispanic candidates in Port Chester.

"In my opinion, the village of Port Chester has already spent entirely too much of the taxpayer's money on appealing this in the first place. While I'm well aware that the cumulative voting process is very unpopular throughout the village, I would like to suggest it has actually served the village very well. The board of trustees, for the first time, reflects the community that voted for it."

11/30/07 - Forget About Judge Robinson




The village plans to proceed with a March 18 election for the Board of Trustees, although allegations of Hispanic-voter discrimination that halted a previous election have yet to be resolved.


The board posted notice this month that it would seek to fill five of the six trustee seats - those held by Gregory Adams, Domenick Cicatelli, John Crane, Joseph Kenner and Robert Sorensen. Candidates will compete for two three-year terms, two two-year terms and one one-year term.


Party leaders are beginning to plan for the election, even though Port Chester awaits U.S. District Judge Stephen Robinson's decision on whether its current at-large election system violates the Voting Rights Act.


His ruling could change how Port Chester's elections are conducted by forcing the village to switch from its at-large, village-wide voting system to one in which trustees are elected from individual districts.......
