Judge raises doubts over Port Chester voting case appeal

NEW YORK — Just as Port Chester prepares to appeal the federal lawsuit that changed its election system, a judge raised doubts Thursday over whether the village had a right to do so. US District Judge Paul Gardephe is handling the final paperwork in the 4-year-old voting rights case, now that Judge Stephen C. Robinson has left the court.


In 2008, Robinson sided with the Justice Department and ruled the old at-large trustee-election system prevented Hispanics from electing their preferred candidates to the board.
Instead of imposing a traditional ward system, he let the village adopt the unusual method of cumulative voting. This lets voters assign their six votes any way they wish — using all six for one candidate or spreading them around.
After signing a consent decree and ushering in the new method, Port Chester decided to appeal, saying the old system never should have been struck down.
Gardephe said during a hearing in Manhattan that he was mystified as to how an appeal could be made. "My understanding of the law is that you may not appeal a consent decree," he said.....
....Randolph McLaughlin, a Pace law professor, said of Port Chester, "Their argument just doesn't make sense. This judge saw right through it."

Port Chester car 'booting' operator loses lawsuit against police over parking row

WHITE PLAINS — A federal judge has dismissed a lawsuit filed by a New Rochelle man against the Port Chester police department over his car "booting" business. Llewellyn "Angelo" Williams, 46, filed the federal lawsuit in the wake of his March 23, 2007 arrest on charges of disorderly conduct and failure to notify police of a booted vehicle.

That arrest came following an argument between Williams and police over an immobilizing device he had attached to the wheel of a car he said was illegally parked in a private parking lot at 12 King St.
Williams had a contract with the owner of the property to boot cars that didn't have permission to park or were not customers of stores connected to the lot.
Port Chester had a requirement at the time that booting operators like Williams had to come to the police station to fill out documents informing police of the booting. Police said Williams had repeatedly failed to follow that requirement. Booting operators can now notify police by calling in the immobilization.
Williams charged people $70 to remove the boot, according to court papers. ...

.....Williams' lawyer, Richard St. Paul, said he might appeal the decision or file a state lawsuit on the claim of contract interference that Yanthis did not address in his decision.

The Port Chester Board of Education approved a $79.56 million budget Thursday evening which will raise the tax levy by 3.31%. That represents a 2.94% budget-to-budget increase.
The board voted 4-1 in favor of the spending plan, with Trustee Blanca Lopez dissenting.
