Village of Mamaroneck replaces legal team in Jewish school case.



MAMARONECK - After losing a federal appeal last week in a case against an Orthodox Jewish School, the village said yesterday that it is consulting with a new law firm on how to proceed.
"We approach every case with the intention of winning and that doesn't always happen," Mayor Phil Trifiletti said. "This was a very complicated case."



Last week, the 2nd U.S. Circuit Court of Appeals upheld a lower court decision that the village zoning board violated a land-use law against religious discrimination in turning down the Westchester Day School's expansion project. Trifiletti said law firm Thacher Proffitt and Wood would no longer handle the case....



... The board adopted a resolution yesterday 5-0 creating a staff attorney position.
"It's time to fix a wheel that's been broken for a very long time," Trustee Toni Pergola Ryan said.



A salary has not been set for the position, but Murphy said a safe estimate would be$160,000. The figure was based on what Port Chester, a neighboring village with a similar makeup to Mamaroneck, pays its attorney. Murphy added the attorney could also require ...

Black population soars in Putnam, stalls in Westchester, Rockland ...

STORY:

Unlike other minority groups whose numbers are booming across the Lower Hudson Valley, the black population in Westchester and Rockland counties has remained almost constant or dipped slightly since the 2000 Census, new government figures show.

But in Putnam, the state's fifth-fastest-growing county, blacks increased their numbers almost 70 percent during the same time.

"Probably they are coming to the county for the same reasons I did: the quietness of the area and the quality of the schools," said Joy Hopkins, who on Monday opened the Lady of Color hair salon in Brewster........

........In Mamaroneck, the growing Hispanic population can be found in the grocery stores, beauty salons and restaurants that cater to immigrants in the village's business district. About 10 years ago, residents created the Hispanic Resource Center to help newcomers adjust to the community.

"We foster integration. We want them to learn English, learn American culture and assimilate," said Mariana Boneo, the center's executive director. "But you can't expect people to leave their culture behind. You want them to bring their culture. It adds to the richness of the areas."
The influx also has caused controversy, and a federal case that last year found village police officers discriminated against Hispanic day laborers - prompting the creation of a local hiring site - continues to divide the community.

Also, Port Chester is awaiting a federal judge's decision on whether its "at large" voting system discriminates against Hispanics.......

MOVED BACK TO 42 IN 45 FEET STARTED PICKING A FEW BLUES, LOST A FEW THEN THE BITE STOPPED SO I MOVED OUT TO WHERE THE PARTY BOATS WERE AND DIDNT SEE ANYTHING TO CAPTURE MY INTEREST. Open houses on Tappan Zee Bridge planned for next month

The public will soon get a detailed look at what the Tappan Zee Bridge corridor from Suffern to Port Chester might look like with a new bridge and mass transit.

Open houses in Rockland and Westchester are scheduled for the end of February, Michael Anderson, team leader for the Tappan Zee/I-287 Project, said.
The dates have not been set.

At stake is the fate of the 51-year-old Tappan Zee Bridge, which carries 135,000 cars and trucks daily. Officials are considering four plans for a new bridge, which include commuter trains, light rail or bus rapid transit. Two options involve keeping the bridge and providing degrees of upgrades and rehabilitation.

Proposed project costs range from $500 million to $14.5 billion.

Town moves to silence plane noise

Annoyed by pilots who ignore a voluntary overnight flight curfew at neighboring Westchester County Airport, Greenwich officials said yesterday that they will seek a mandatory grounding of planes from midnight to 6:30 a.m.

In a series of announcements related to aircraft noise, the town also said it will hire a consultant to study a federal proposal to reroute planes over the area.

'Our area is getting hammered, in my opinion, by overflights from Kennedy, La Guardia and Newark,' said Erica Purnell, vice chairman of the Selectmen's Advisory Committee on Aircraft Noise.

The town recently formed the committee to come to terms with a quality of life issue that officials said was not being properly addressed at the local level.

Four of the committee's 18 members are current or former pilots, including chairman Bruce Dixon, who said he hopes to form a working group with his fellow aviators to discuss adherence to existing aircraft routes with air traffic controllers at Westchester County Airport.
Current flight patterns call for aircraft approaching the Rye Brook airport to begin their descent over Long Island Sound, a procedure that town officials say is often ignored to save fuel and diverts planes over Greenwich.

'You probably heard the phrase cutting the corner,' Dixon said during a news conference at Town Hall.

Another area of concern are breaches of the voluntary overnight curfew at the airport. Flights betwen midnight and 6:30 a.m. averaged about 13 per night in 2006, up from about 10.8 per night in 2005, according to the airport's noise abatement office.

Arlene Murray, a spokeswoman for the Federal Aviation Administration, said the agency has a process for handling mandatory curfew requests.

'They would have to show the FAA that they are not impacting interstate commerce and also that they would not unduly impacting the aviation industry,' said Murray, who noted that no other airports in the region have a mandatory curfew.

A mandatory curfew would not be new, as the airport had one that was challenged by the FAA and thrown out by the courts in the early 1980s and replaced with a voluntary one. In April 2001, the county closed the airport's parking garage from 12:30 a.m. to 5:50 a.m. to discourage travelers from taking flights that violated the voluntary curfew. Federal regulations forced the county to reopen the garage overnight after the Sept. 11, 2001, terrorist attacks, however.Rep. Christopher Shays, R-Conn., pledged his support for the town's effort.
